Terms of Use

By using this application, you acknowledge that you have read and reviewed this agreement and that you agree to comply with its terms. If you do not wish to be bound by the terms of this agreement, you are advised to leave the application accordingly. The ability to use and access this application is granted only to those who have accepted its terms.

Intellectual Property

You agree that all materials, products, and services provided in this application are the property of FittiCoin, its affiliates, directors, officers, employees, agents, suppliers, and licensors, including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute FittiCoin's intellectual property in any form, including electronic or digital recordings, or new trademark registrations.

You grant FittiCoin a royalty-free, non-exclusive license to display, post, use, copy, transmit, and broadcast the content you upload. For matters related to intellectual property claims, you should contact the company in order to reach an agreement.

User Accounts

As a user of this application, you may be asked to register with us and provide private information about yourself. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account.

If you believe there is any potential issue regarding the security of your account on the application, inform us immediately so we may address it accordingly.

We reserve all rights to terminate accounts, edit or remove content, and cancel reward redemptions at our sole discretion.

Applicable Law

By installing this application, you agree that the laws of the country, without regard to principles of conflict of laws, will govern these terms and conditions, or any dispute of any sort that may arise between you and FittiCoin, or between you and its partners and affiliates.

Disputes

Any dispute related in any way to your visit to this application or to the rewards you redeem from us or from any of our store partners shall be arbitrated by a state or federal court, and you consent to the exclusive jurisdiction and venue of such courts.

Indemnification

You agree to indemnify FittiCoin and its affiliates and hold FittiCoin harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Abuse or Fraud Attempts

Please note that any attempt in any way to falsify step counts, or attempts to count steps without moving, will give us the authority to reject those steps and apply penalties such as deducting steps and FittiCoins, or cancelling the account.

Limitation of Liability

FittiCoin is not responsible for any damages that may occur to you as a result of your misuse of our application. FittiCoin reserves the right to edit, modify, and change this agreement at any time. We will inform our users of these changes through email or in-app pop-up messages. This agreement is an understanding between FittiCoin and the user, and it supersedes and replaces all prior agreements regarding the use of this application.

Information You Provide to Us

We collect information that you provide to us directly through your access to or use of the services. For example, when you create or modify your account, request on-demand services, contact customer support, or otherwise contact us. This information may include: your name, your email, phone number, postal address, profile picture, payment method, financial data and credit card information, and any other information you choose to provide us.

We also use GPS technology to determine your current location. Some of our location-enabled services require your personal data in order to function in the future. If you wish to use a particular feature, you will be asked to consent to the data being used for this purpose.

Use of Personal Data

We may use the personal information you provide to us or that we collect from you for the following purposes:

• Customer support for users, developing security features, authorizing users, and sending product upgrades, updates, and administrative messages.

To maintain the integrity of our databases, to perform services on an ongoing basis on your behalf, for research, analytics, and statistical purposes, and to ensure compliance with applicable laws and regulations, we retain the personal and demographic information provided by users for an extended period of time. FittiCoin shall not be responsible for the accuracy of the information you provide, and will modify and update your personal information in our databases upon your request. We will erase or archive your personal information from active use if required to do so by a specific law or upon your request. By accessing or using the services, you hereby warrant and represent that you understand that all information provided through the services or otherwise to FittiCoin may be used by FittiCoin in accordance with applicable laws, this privacy policy, and the customer terms and conditions of use.

Sharing of Personal Data

We may share the personal data we collect about you as described in this statement or as described at the time the information is collected or shared, including as follows:

• Through our services.
• With third parties you choose to allow us to share your personal data with, that integrate with our API or services, or an API or service with which we integrate.
• With your employer (or a similar entity) and any necessary third parties engaged by us or by your employer, if you participate in any of our enterprise solutions.

Other Important Sharing

• We may share your personal data with FittiCoin subsidiaries and affiliated entities, agents, consultants, marketing and advertising partners, and other service providers who need access to such personal data to perform work on our behalf, or to carry out any contract we enter into with them.
• In response to a request for information by a competent authority if we believe disclosure is in accordance with, or otherwise required by, any applicable law, regulation, or legal process.

Your FittiCoin profile is password-protected so that only you and authorized FittiCoin employees have access to your account information. A FittiCoin employee will never proactively contact you and ask for any personal account information, including your password.

The FittiCoin application makes every possible effort to ensure the security and protection of your personal data within its system. There are employees at FittiCoin dedicated to maintaining the privacy policy set forth herein and any other privacy initiatives, periodically reviewing the security of the application, and ensuring that every FittiCoin employee is aware of security practices. Unfortunately, the protection of any data transmitted over the internet cannot be guaranteed 100%. As a result, FittiCoin cannot guarantee the security of any personal data you transmit or send to it, and you do so at your own risk.
